1. About These Terms

These Terms and Conditions (“Terms”) apply to all purchases of products and services made through Axiom Exams.

Axiom Exams is a trading name operated by Jade Powell as a sole trader.

By placing an order for an Assessment or any other product or service, booking a Consultation, or otherwise using our services, you agree to be bound by these Terms.

These Terms should be read together with the information provided on the relevant product or service page before you place your order.

If there is any conflict between these Terms and specific information provided about a particular product or service before purchase, the product or service information will take precedence to the extent necessary.

Nothing in these Terms excludes, limits or affects any statutory rights that cannot legally be excluded or limited under applicable consumer law.

A contract between you and Axiom Exams is formed when we accept your order, which will normally be confirmed by email.


2. Definitions

In these Terms, the following words have the meanings set out below:

Assessment means an online diagnostic educational assessment provided by Axiom Exams.

Assessment Reference Number means the unique reference number allocated to an Assessment purchase to help identify the relevant Assessment, responses and associated services.

Child means the child for whom an Assessment or other service has been purchased.

Consultation means an optional parent consultation provided by Axiom Exams.

Customer, you or your means the person purchasing a product or service from Axiom Exams.

Digital Content means any Assessment, Report, Workbook, digital course or other educational material supplied electronically.

Personalised Workbook or Workbook means the optional personalised educational workbook prepared for the Child.

Personalised Report or Report means the personalised assessment report prepared following completion of an Assessment.

Services means any products or services provided by Axiom Exams, including (but not limited to) Assessments, Reports, Workbooks, Consultations, educational resources, tutoring services, courses and any future educational products or services that we may offer.

Working Day means Monday to Friday, excluding public holidays in England and Wales.

3. Our Services

Axiom Exams provides teacher-designed educational assessments and learning resources intended to support children preparing for 7+ and 8+ independent school entrance examinations and other educational assessments.

Our Services may include, but are not limited to:

  • Online diagnostic Assessments;
  • Assessment analysis;
  • Personalised Reports;
  • Personalised Workbooks;
  • Educational recommendations;
  • Parent Consultations;
  • Tutoring services (subject to availability)
  • Educational courses; and
  • Other educational resources or services that we may introduce from time to time.

The products, services and deliverables included will depend on the particular product or service purchased and will be described on the relevant product or service page before you place your order.

We reserve the right to amend, improve, replace or discontinue any product or service where reasonably necessary. Any such changes will not affect products or services already purchased unless the change is required by law or is otherwise agreed with you.


4. Purpose and Limitations of Our Assessments

Our Assessments are designed to provide an educational indication of a Child’s current level of performance at the time the Assessment is completed.

Depending on the service purchased, a Report may include:

  • Assessment scores;
  • Performance summaries;
  • Areas of strength;
  • Areas identified for further development;
  • Personalised learning recommendations;
  • Suggested practice activities; and
  • Guidance to support future preparation.

All Reports and recommendations represent the professional educational opinion of Axiom Exams based on the information available at the time of assessment, including the Child’s Assessment responses and any additional information provided by you.

Educational recommendations are intended to support learning and preparation only. They should not be regarded as guarantees of future educational outcomes or as professional medical, psychological or specialist educational advice.

Assessment results should be viewed as educational guidance only.

Axiom Exams does not guarantee:

  • admission to any school;
  • success in any entrance examination;
  • a particular assessment score;
  • a pass or fail outcome;
  • future academic performance;
  • improvement in educational performance; or
  • that following our recommendations will achieve any particular result.

Educational outcomes depend upon many factors beyond our control, including a Child’s preparation, effort, confidence, individual development, health, wellbeing, attendance, circumstances at the time of assessment and the admission criteria or selection process operated by the relevant school.

Our Assessments, and Reports are independent educational resources. They are not:

  • official school entrance examinations;
  • assessments conducted by any school or examination provider;
  • guarantees of admission to any educational establishment;
  • guarantees of examination success;
  • formal educational, medical or psychological assessments; or
  • substitutes for a school’s own admissions procedures or professional advice from appropriately qualified specialists.

We provide all Services with reasonable care and skill in accordance with applicable consumer law.


5. Purchasing an Assessment

When purchasing an Assessment or other Service from Axiom Exams, you confirm that:

  • the information you provide is accurate and complete to the best of your knowledge;
  • you are the parent, legal guardian or another person authorised by the parent or legal guardian to arrange the Service on behalf of the Child;
  • you provide a valid email address for communication;
  • the Assessment is purchased for the intended Child only; and
  • you will comply with these Terms.

We rely on the information provided by you when preparing Reports and recommendations. You are responsible for ensuring that information provided to us is accurate and complete. We are not responsible for errors or limitations arising from inaccurate, incomplete or outdated information supplied by you.

Your email address is required so that we can:

  • confirm your purchase;
  • provide Assessment instructions;
  • provide your Assessment Reference Number;
  • provide access to the Assessment;
  • deliver Reports or other Digital Content requested by you;
  • arrange Consultations where applicable; and
  • provide customer support relating to your purchase.

Your order constitutes an offer to purchase the relevant product or Service.

A contract is formed when we accept your order, normally when we send an order confirmation email.

We reserve the right to refuse or cancel an order where we reasonably believe that:

  • fraudulent or misleading information has been provided;
  • these Terms have been breached;
  • our Services are being misused;
  • abusive or inappropriate behaviour has occurred towards Axiom Exams; or
  • we are unable to provide the Service safely or reasonably.

Where an order is cancelled by us, any refund due will be provided in accordance with applicable consumer law.


6. Assessment Validity and Expiry

Assessments must normally be completed within six (6) months of the date of purchase unless we agree otherwise in writing.

If an Assessment has not been completed within this period, the Assessment may expire and access may be withdrawn.

Where an Assessment expires due to inactivity, we will have no obligation to provide the outstanding Assessment, Report or any other Service or Digital Content that has not been provided, unless otherwise agreed with you or required by applicable consumer law.

If we require additional information, responses, uploads or materials from you in order to provide the Service, you must provide these within six (6) months of purchase.

If we have not received the required information within this period, we may close the order.

Once an order has been closed, we will have no further obligation to provide the outstanding Services unless otherwise agreed with you.


7. Assessment Reference Numbers and Security

Each purchased Assessment is assigned a unique Assessment Reference Number.

The Assessment Reference Number helps us associate your purchase, Assessment responses and Report while reducing the need to use unnecessary personal information.

If you purchase more than one Assessment, a separate Assessment Reference Number may be issued for each Assessment.

You are responsible for keeping your Assessment Reference Number, assessment links and access details secure.

You must not:

  • share Assessment links or access details with another person;
  • allow another child to complete an Assessment purchased for a different Child;
  • provide access to unauthorised individuals; or
  • attempt to access another customer’s Assessment, information or materials.

We are not responsible for unauthorised use resulting from access details being shared by you.


8. Completing an Assessment

To ensure that an Assessment provides the most useful diagnostic information:

  • the Assessment must be completed by the intended Child;
  • the Child should complete the questions independently; and
  • the Child should complete the Assessment based on their own knowledge and ability.

Parents or guardians should provide a suitable environment and may assist with technical matters, such as entering answers, uploading photographs or resolving technical difficulties.

Parents or guardians may clarify instructions where necessary but must not:

  • provide answers;
  • guide the Child towards correct responses;
  • coach the Child through questions; or
  • otherwise assist the Child in completing the Assessment.

If a Child receives substantial assistance, the results may not accurately reflect the Child’s independent ability.

Where we believe an Assessment has not been completed independently, we reserve the right to note this in the Report, invalidate the Assessment or take other reasonable action.

Reports may still be produced based on the responses submitted where appropriate, but the results may not provide an accurate indication of the Child’s independent performance.

Each Assessment is intended for one Child only.

An Assessment cannot be:

  • transferred to another Child;
  • completed by another person;
  • repeated because a customer is dissatisfied with the outcome; or
  • retaken in order to obtain a different result.

We do not provide replacement Assessments solely because a customer is unhappy with the Assessment outcome.

9. Assessment Materials and Intellectual Property

All materials provided by Axiom Exams remain the intellectual property of Axiom Exams unless expressly stated otherwise.

This includes, but is not limited to:

  • Assessment questions;
  • Question banks;
  • Assessment structures and formats;
  • Marking approaches;
  • Educational Courses
  • Reports;
  • Personalised Workbooks;
  • Educational resources;
  • Written materials;
  • Website content;
  • Branding;
  • Logos; and
  • Any other materials created or supplied by Axiom Exams.

Nothing in these Terms transfers ownership of any intellectual property rights belonging to Axiom Exams.

Materials supplied by Axiom Exams are provided for the personal educational use of the Child for whom the Assessment or Service was purchased.

You may:

  • use Reports for the Child’s own educational purposes;
  • download and retain copies of digital materials supplied to you; and
  • use recommendations and activities to support the Child’s learning.

You must not, without our prior written permission:

  • copy or reproduce Assessment questions;
  • reproduce, distribute or share Assessment materials;
  • publish Assessment content online;
  • upload Assessment questions or materials to any website, platform or social media;
  • sell, licence or commercially exploit Axiom Exams materials;
  • use our materials to create competing products or services;
  • provide our materials to another child or family;
  • attempt to extract, copy or recreate our question banks or assessment systems; or
  • attempt to access materials intended for another customer.

Any unauthorised use of Axiom Exams materials may result in suspension or termination of access to our Services and may constitute infringement of our intellectual property rights.


10. Reports and Personalised Workbooks

A Personalised Report is provided following completion of an Assessment and forms part of the Assessment service where stated on the relevant product page.

The Report is prepared using the Child’s Assessment responses and performance and may include:

  • Assessment scores;
  • Performance summaries;
  • Areas of strength;
  • Areas identified for development;
  • Targeted activities designed to support identified areas for development;
  • Recommended activities;
  • Learning suggestions; and
  • Preparation guidance.

A Personalised Workbook is an optional additional service and is not included with an Assessment unless expressly stated on the relevant product or service page.

Where available, a Personalised Workbook may be purchased separately following an Assessment and, where applicable, a Parent Consultation. The Workbook is intended to provide targeted practice based on areas identified through the Child’s Assessment performance.

Personalised Workbooks may contain questions selected from Axiom Exams’ question banks and may include content intended to consolidate existing knowledge, address areas for development or provide appropriate challenge.

Workbooks are individually prepared resources and may therefore differ between children.

Reports and Workbooks are intended to provide educational guidance based on the Child’s performance at the time the Assessment was completed.

They are not:

  • formal school assessments;
  • official entrance examination results;
  • professional medical, psychological or specialist educational diagnoses;
  • guarantees of examination success; or
  • replacements for advice from a school or appropriately qualified educational professional.

All Reports, Workbooks and recommendations represent the professional educational opinion of Axiom Exams based on the information available at the time of preparation.

Axiom Exams uses reasonable care and skill when preparing Reports and Workbooks.

Where a personalised workbook is included as part of an Axiom Exams assessment, the workbook is created using the child’s assessment responses and performance, together with professional educational judgement.

The purpose of the workbook is to provide targeted practice based on areas identified through the assessment. Content may include questions designed to consolidate skills, address areas for development and provide appropriate challenge.

We recognise that parents and children may have different views regarding the level of difficulty or suitability of particular questions. If you have concerns about a personalised workbook, please contact us and we will consider your feedback alongside the assessment information and workbook content.

Where appropriate, and at our discretion, we may make reasonable adjustments or provide additional guidance. However, personalised workbooks are individually prepared resources and we are unable to guarantee amendments, replacements or refunds where a parent or child would prefer different content, a different level of difficulty, or a different style of question.

Any decision to provide an amendment or additional support is made on a case-by-case basis and does not create an ongoing obligation to make further changes.

Assessment Basis and School Variation


Axiom Exams assessments and reports are designed to reflect skills and levels of difficulty commonly associated with preparation for 7+ and 8+ school entrance examinations. They are developed using the professional judgement and experience of a qualified teacher and are intended to provide an indication of a child’s current strengths and areas for development.

Entrance examination requirements vary between individual schools. Individual schools may assess different subjects, topics, skills, question types or levels of difficulty, and not all knowledge or skills assessed by a particular school will necessarily be included in an Axiom Exams assessment. Likewise, completion of an Axiom Exams assessment, digital course, report or workbook does not guarantee readiness for, performance in, or admission to any particular school’s entrance examination.

Parents should therefore consider the specific requirements of the schools to which they intend to apply and should not rely solely on an Axiom Exams assessment or report when determining their child’s preparation needs.


11. Delivery and Retention of Reports and Workbooks

Reports are delivered electronically to the email address provided at purchase. Where a Personalised Workbook has also been purchased or is expressly included in the relevant product, the Workbook will also be delivered electronically.

We aim to provide completed Reports within three (3) Working Days of:

  • the Assessment being completed; and
  • all required responses, uploads and information being received.

Where multiple Assessments have been purchased together, the three (3) Working Day timeframe will normally begin once the final Assessment has been completed and all required information has been received.

The timeframe above is an estimated delivery timeframe unless a different timeframe has been expressly agreed with you.

If we expect a significant delay, we will communicate this as soon as reasonably practicable.

Where a Personalised Workbook has been purchased, we will aim to provide the completed Workbook within the timeframe stated on the relevant product or service page or, where no timeframe is stated, within a reasonable period.

Customers are responsible for retaining copies of Reports and Workbooks once delivered.

We will normally retain copies of Reports and Workbooks for up to six (6) months after delivery. During this period, we may be able to resend copies if requested.

After this period, we may permanently delete copies of Reports and Workbooks in accordance with our Privacy Policy and data retention practices.

This does not affect any rights you may have under applicable data protection law.


12. Use of Artificial Intelligence (AI)

Axiom Exams may use artificial intelligence (AI)-assisted tools to support the preparation of educational resources, Reports, Personalised Workbooks, recommendations and other materials.

AI tools are used as an assistive tool only and do not replace professional review, judgement or decision-making.

AI-generated content may be edited, amended, reviewed or rewritten before being supplied to customers.

All personalised Reports, Workbooks, recommendations and educational materials provided to customers are reviewed and approved by Axiom Exams before being supplied.

The use of AI-assisted tools does not:

  • transfer ownership of Axiom Exams materials;
  • reduce our responsibility to provide Services with reasonable care and skill; or
  • affect the intellectual property rights relating to materials provided by Axiom Exams.

13. Parent Consultations

Where available, customers may purchase or book an optional Parent Consultation with Axiom Exams.

Consultations may include discussion of:

  • Assessment feedback;
  • Preparation questions;
  • Areas for further practice;
  • Supporting progress at home;
  • Suggested next steps; and
  • General educational guidance, including preparation guidance and suggested study resources.

Consultations are guidance sessions intended to support parents in understanding Assessment results and planning appropriate preparation.

Consultations are not:

  • tutoring sessions;
  • formal school entrance examinations;
  • professional medical, psychological or specialist educational assessments;
  • guarantees of examination success; or
  • substitutes for advice from schools or appropriately qualified professionals.

Consultations are conducted by Jade Powell, a qualified primary teacher holding Qualified Teacher Status (QTS) in England.

Consultations are not recorded unless expressly agreed in writing in advance.


Booking and Rescheduling Consultations

Consultations must normally be booked at least twenty-four (24) hours in advance.

Customers may request to reschedule a Consultation by providing at least fourteen (14) days’ notice before the scheduled appointment.

Where sufficient notice is provided, we will make reasonable efforts to arrange an alternative appointment within a reasonable period, subject to availability.

If a customer fails to attend a scheduled Consultation:

  • the appointment will be treated as used;
  • no refund will be provided; and
  • we are not obliged to provide a replacement appointment.

If a customer arrives late for a Consultation, the Consultation will normally end at the scheduled finishing time and will not be extended.

A late arrival does not entitle the customer to a refund or rescheduled appointment.

Tutoring Services

Where available, Axiom Exams may offer one-to-one online tutoring for children preparing for entrance examinations or other educational assessments.

Submitting a tutoring enquiry through our website or by any other means does not guarantee that tutoring will be available and does not create a contract between you and Axiom Exams.

Tutoring places are subject to availability. We reserve the right to accept or decline enquiries at our discretion, including where:

  • we have reached capacity;
  • we believe our Services are not suitable for the Child’s needs;
  • we are unable to offer tuition at the requested times; or
  • we are otherwise unable to provide the requested Service.

Where we are unable to offer tutoring immediately, we may operate a waiting list and contact you if a place becomes available.

Tutoring lessons will normally be one (1) hour in duration. Unless otherwise agreed, the current fee is £125 per hour. The applicable fee will be confirmed before any tutoring is booked and may be updated for future bookings.

Tutoring sessions are booked using Google Calendar and payment is made securely through the payment method provided at checkout on our website.

Tutoring may make use of a range of educational resources selected by Axiom Exams. These may include Axiom Exams materials together with third-party educational resources where we believe they are appropriate to support the Child’s learning. All third-party materials remain the intellectual property of their respective owners and will be used in accordance with applicable copyright and licensing requirements.

Where tutoring is offered, we will confirm the agreed lesson schedule, fees and any additional arrangements before tuition begins.

A contract for tutoring is formed only when we confirm your booking and receive any required payment.

Rescheduling and Cancellations

If you need to reschedule a tutoring lesson, you must normally provide at least fourteen (14) days’ notice. Requests made with less notice may be accommodated at our discretion but cannot be guaranteed.

If you cancel a tutoring lesson within forty-eight (48) hours of the scheduled start time, no refund will be provided.

If a pupil arrives more than fifteen (15) minutes after the scheduled start time without prior agreement, the lesson will be treated as cancelled. The lesson will not be extended, rescheduled or refunded.

If Axiom Exams needs to cancel a lesson, we will offer you the choice of:

  • rescheduling the lesson to a mutually convenient time; or
  • receiving a full refund for the cancelled lesson.

If, in the future, Axiom Exams works with other suitably qualified tutors, we may offer to introduce you to another tutor where appropriate. We will not share your personal information with another tutor without your knowledge and, where required by law, your consent.


14. Payments and Prices

Payments for Axiom Exams products and Services are processed securely through the payment provider available at checkout.

Payment must be completed before access to Assessments, Digital Content, Reports, Workbooks or Consultations is provided, unless otherwise agreed by us.

Prices displayed on our website are the prices applicable at the time of purchase.

All prices will be clearly displayed before you complete your order.

We reserve the right to correct obvious pricing errors.

If we identify an obvious pricing error after you have placed an order, we will contact you and provide you with the option to:

  • proceed with the purchase at the correct price; or
  • cancel your order and receive a refund of any amount already paid.

If you choose to cancel because of a pricing error, we will refund any payment made as soon as reasonably practicable.


15. Future Services

Axiom Exams may introduce additional educational products and Services in the future, including (but not limited to):

  • educational courses;
  • preparation programmes;
  • additional digital resources; and
  • other educational support services.

Any future Services will be governed by these Terms unless separate terms are provided for the relevant Service.

Where a future Service has specific requirements, those requirements will be communicated before purchase.

16. Cancellation and Refunds

16.1 Your Statutory Consumer Rights

If you are a consumer purchasing Services online, you may have statutory rights under applicable consumer law, including rights relating to cancellation, digital content and services.

Nothing in these Terms removes or restricts any statutory rights that cannot legally be removed or restricted.

The cancellation rights that apply may depend on the nature of the Service purchased.

Axiom Exams provides a combination of:

  • digital assessment access;
  • assessment analysis services;
  • personalised Reports;
  • personalised Workbooks;
  • tutoring;
  • consultations; and
  • other educational Services.

Different cancellation rules may apply depending on which part of the Service has been provided.


16.2 Assessment Access and Start of Services

After purchasing an Assessment, you will receive confirmation of your order.

We will normally provide:

  • your Assessment Reference Number;
  • instructions for completing the Assessment; and
  • access to the Assessment,

within twenty-four (24) hours of purchase.

The Assessment itself is a standard diagnostic assessment selected by you from the available Assessment options, created by Axiom Exams. The Assessment questions are not individually created for each Child.

Where required by law, we will obtain any necessary acknowledgement or confirmation before providing immediate access to Digital Content or beginning a Service during the statutory cancellation period.

Where an Assessment expires because it has not been completed within the six (6) month validity period, no refund will normally be provided unless required by applicable consumer law.


16.3 Personalised Reports and Workbooks

Personalised Reports are prepared after the Child has completed the Assessment. Where a Personalised Workbook has also been purchased, or is expressly included in the relevant product, the Workbook will be prepared following completion of the Assessment. Where a Personalised Workbook is included in the particular product purchased, the Workbook will be created using the Child’s Assessment responses and performance.

Preparation may involve:

  • reviewing Assessment responses;
  • analysing performance;
  • identifying areas of strength and development;
  • selecting appropriate practice activities;
  • preparing personalised recommendations; and
  • creating a personalised Workbook.

Because these Services involve work carried out specifically for the Child, cancellation rights may be affected once preparation has begun.

If you cancel after the Assessment has been completed but before the Report has been delivered, we may retain an amount that reflects the work already completed, where permitted by law.

Any amount retained will be calculated based on the value of the Service already provided and will not operate as a fixed cancellation fee or penalty.

Personalised workbooks are created specifically for your child based on their assessment responses and performance. Because Personalised Workbooks are created specifically for the Child based on their Assessment responses and performance, a preference for different recommendations, activities, question styles or levels of difficulty will not, by itself, entitle the Customer to a refund. This does not affect any statutory rights the Customer may have where the Service is faulty, misdescribed or has not been provided with reasonable care and skill.

If you believe there has been an error in the preparation of your child’s report or workbook, please contact us at hello@axiomexams.co.uk and we will review your concern and consider an appropriate resolution.


16.4 Digital Content

Some Axiom Exams products are Digital Content supplied electronically, including:

  • Assessment access;
  • Reports;
  • Personalised Workbooks;
  • educational resources; and
  • prerecorded courses.

Where Digital Content is supplied before the end of the statutory cancellation period, we will obtain any acknowledgement required by law that:

  • you have requested immediate supply of the Digital Content; and
  • you may lose any statutory right to cancel that Digital Content contract once supply begins, where applicable.

16.5 Prerecorded Courses

Where Axiom Exams provides prerecorded courses or other digital learning materials, these may be supplied electronically.

Where access is provided immediately after purchase, we will obtain any required acknowledgement that:

  • you have requested immediate access; and
  • your statutory cancellation rights may be affected once access begins, where applicable.

16.6 How to Cancel

If you wish to cancel a contract where you have a legal right to do so, please contact:

You may clearly tell us that you wish to cancel. You do not need to use a specific format.

You may use the following wording if you wish:

“I hereby give notice that I wish to cancel my contract with Axiom Exams for the following Service:

Name:
Email address:
Order number or Assessment Reference Number:
Date of purchase:
Date of cancellation request:”

Providing your order number or Assessment Reference Number will help us identify your purchase more quickly.

If you believe a payment has been taken in error or there is an issue with your purchase, please contact us before initiating a payment dispute or chargeback so that we have the opportunity to resolve the matter promptly.


16.7 Refunds

Where you cancel a contract and a refund is due under applicable consumer law, we will provide the refund in accordance with those requirements.

Where the law requires a full refund, we will provide a full refund. Any refund will normally be made using the same payment method used for the original purchase unless otherwise agreed.

Where a Service has already begun, including assessment analysis or preparation of personalised materials, we may deduct a proportionate amount for the work completed up to the date you notify us of cancellation, where permitted by law.

We will consider:

  • whether the Assessment has been accessed or completed;
  • whether assessment analysis has begun;
  • whether a Report or Workbook has been prepared;
  • whether Digital Content has been supplied; and
  • the amount of work already completed.

We will not apply automatic cancellation fees or penalties.

Where a refund is due, we aim to process it within 14 days of agreeing that a refund is payable, unless a shorter period is required by law. Refunds will be based on the amount actually paid for the relevant Service.

If you accidentally purchase the same Assessment more than once, please contact us as soon as possible. Where no Assessment has been accessed or Service provided, we may issue a refund at our discretion.

If we are unable to provide the Service because required information, Assessment responses or uploaded work has not been received from you within the applicable timeframe, any refund will be at our discretion unless required by law.

Refunds relating to Parent Consultations are subject to the cancellation provisions set out in Section 13.

Refunds relating to tutoring lessons are subject to the tutoring cancellation policy set out in these Terms.

Nothing in these Terms prevents Axiom Exams from offering a refund, replacement Service or other goodwill gesture where we consider it appropriate.

This section does not affect your statutory rights where Services are not provided with reasonable care and skill or where other consumer protections apply.

Exceptional Circumstances

We may consider requests outside of the above circumstances at our discretion and on a case-by-case basis. Any decision to provide a refund, credit or alternative resolution does not create an obligation to provide the same remedy in future cases.

Your statutory consumer rights are not affected.

If you believe that:

  • a Service has not been provided as described;
  • a Service has not been provided with reasonable care and skill;
  • there is an error with the digital content that you have received; or
  • you have another concern about our Services,

Your statutory rights are not affected by these Terms.

19. Technical Issues and Third-Party Providers

Axiom Exams uses trusted third-party platforms and providers to help deliver our Services.

These may include providers used for:

  • website hosting;
  • online payments;
  • assessment delivery;
  • video hosting;
  • document storage;
  • email communications;
  • customer management; and
  • other business services.

We take reasonable care when selecting third-party providers and will take reasonable steps to minimise disruption where technical issues occur.

If technical problems prevent you from accessing, completing or using any part of our Services, please contact us as soon as reasonably possible.

  • issue a replacement Assessment link;
  • provide additional completion time;
  • resend relevant materials; or
  • take another reasonable step to resolve the issue.

We are not responsible for interruptions, failures or delays caused by third-party services outside our reasonable control.

This does not affect your statutory rights where a Service has not been provided in accordance with applicable consumer law.


20. Customer Responsibilities and Acceptable Use

When using Axiom Exams Services, you agree that you will not:

  • share Assessment links, Assessment Reference Numbers or access details with unauthorised people;
  • allow an Assessment purchased for one Child to be completed by another Child;
  • provide unauthorised access to Reports, Workbooks or educational materials;
  • copy, reproduce, distribute or publish Assessment questions or materials;
  • upload Assessment content online or share it publicly;
  • use Axiom Exams materials for commercial purposes without written permission;
  • use our materials to create competing products or services;
  • attempt to access another customer’s information or materials;
  • attempt to bypass security measures or access controls; or
  • misuse our Services in any way.

You are responsible for ensuring that your use of our Services complies with these Terms.


21. Suspension and Termination of Access

We may suspend access to an Assessment, Digital Content or other Service where we reasonably believe that:

  • these Terms have been breached;
  • our Services have been misused;
  • there is a security concern;
  • unauthorised access has occurred; or
  • investigation is required before deciding an appropriate action.

We will take reasonable steps to restore access where appropriate.

Where a serious breach occurs, including deliberate misuse, fraud or infringement of our intellectual property rights, we may refuse future access to our Services.

Where required by law, any refund will be considered in accordance with applicable consumer rights.


22. Circumstances Beyond Our Reasonable Control

We will not be responsible for delays or failures caused by circumstances outside our reasonable control, provided that we take reasonable steps to minimise the impact and resume providing the Service as soon as reasonably practicable.

Circumstances outside our reasonable control may include:

  • major website failures;
  • technology failures;
  • third-party platform outages;
  • internet failures;
  • cybersecurity incidents;
  • serious illness or incapacity;
  • natural events; or
  • other unexpected circumstances beyond our reasonable control.

This section does not remove any statutory rights you may have where the law provides a remedy for a failure to provide a Service.


23. Limitation of Liability

Nothing in these Terms excludes or limits any liability where it would be unlawful to do so.

This includes liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of your statutory rights as a consumer that cannot legally be excluded or restricted; or
  • any other liability that cannot legally be limited or excluded.

Subject to the above and to the fullest extent permitted by law, Axiom Exams’ total liability arising out of or in connection with any contract between us shall not exceed the total amount paid by you for the specific Service giving rise to the claim.

We are not responsible for any loss or damage arising from:

  • inaccurate, incomplete or outdated information provided by you;
  • a Child receiving assistance during an Assessment that affects the reliability of the results;
  • decisions made by schools, admissions panels or examination providers;
  • a Child’s performance in any examination or assessment after using our Services;
  • your use of Reports, Workbooks or recommendations without considering the individual circumstances of the Child;
  • interruptions or failures of third-party platforms or services that are outside our reasonable control, where we have taken reasonable steps to minimise disruption;
  • indirect or consequential losses;
  • loss of opportunity, loss of chance or loss of expectation; or
  • disappointment arising from educational outcomes, including failure to obtain admission to a particular school or achieve a particular examination result.

Our Reports, Workbooks, Assessments, Consultations and other educational Services are provided for educational guidance only and should not be relied upon as medical, psychological, legal or other professional advice.

Nothing in these Terms limits our obligation to provide our Services with reasonable care and skill or affects any statutory consumer rights available to you under applicable law.

24. Data Protection and Privacy

We process personal information in accordance with applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Our Privacy Policy explains:

  • what personal information we collect;
  • how we collect and use personal information;
  • the lawful bases we rely on when processing information;
  • how we protect personal information;
  • how long information is retained;

Because our Services involve educational assessments for children, we may process information relating to a Child, including:

  • the Child’s name or identifying information;
  • assessment responses;
  • assessment results;
  • educational information provided by parents or guardians;
  • written work or photographs uploaded as part of the Assessment process; and
  • information required to prepare Reports, Workbooks and recommendations.

By purchasing our Services, you confirm that you are the parent, legal guardian or authorised person responsible for providing information about the Child.

You are responsible for ensuring that you have the appropriate authority to provide information about the Child to Axiom Exams.

We may use trusted third-party service providers to help us provide our Services, including providers used for:

  • website hosting;
  • payment processing;
  • assessment delivery;
  • document creation and storage;
  • email communications;
  • video hosting;
  • customer support; and
  • artificial intelligence-assisted tools.

We take reasonable steps to protect personal information but cannot guarantee the security of information transmitted over the internet.


25. Customer Communications

When you purchase an Assessment or other Service, we may send essential communications relating to your purchase.

These communications may include:

  • order confirmations;
  • payment confirmations;
  • Assessment Reference Numbers;
  • Assessment access instructions;
  • requests for information needed to provide the Service;
  • Assessment-related communications;
  • Report and Workbook delivery;
  • Consultation booking information; and
  • customer support messages.

These communications are necessary to provide the Service you have purchased.

We may send optional marketing communications, including:

  • educational advice;
  • preparation guidance;
  • information about new Assessments;
  • information about tutoring, courses or other Services; and
  • business updates,

where we have your consent where required by law or where another lawful basis applies.

You can unsubscribe from marketing communications at any time by using the unsubscribe instructions provided or by contacting us.

Unsubscribing from marketing communications will not prevent us from sending essential service-related communications.

The Terms that apply to your purchase will normally be the version available at the time your contract is formed.

We may update these Terms after purchase where:

  • we are required to do so by law;
  • the change does not materially affect your rights;
  • the change relates to improvements to our Services; or

These Terms and any contract between you and Axiom Exams are governed by the law of England and Wales.

If you are a consumer, you will also benefit from any mandatory consumer protection rights that apply under the laws of the country where you live.

Nothing in these Terms prevents you from relying on any legal rights available to you.
